Failure to comply with these provisions may result in the suspension or cancellation of access to the website, without prejudice to any legal action Standout may take to protect its interests and those of its customers.

Standout acts exclusively as an intermediary in the purchase, sale, and rental of real estate. Transactions are facilitated, managed, and supervised by Standout , but the ultimate responsibility for the delivery and fulfillment of agreements rests with the property owners or developers.
5.1. Intermediation in the Purchase and Sale of Properties
Standout offers a connection and advisory service between buyers and investors with sellers and real estate developers.
Steps in the Purchase/Sale Process:
- Information Request: Interested buyers can request details about a property through the website or by directly contacting Standout 's sales team.
- Feasibility Analysis: Financial advice, valuation analysis, and verification of commercial suitability are provided.
- Property or Project Visit: An in-person or virtual visit is arranged to learn more about the property.
- Negotiation and Agreement Closing: Standout acts as an intermediary in the negotiation of terms and conditions.
- Contract Signing: The sales contract is signed between the buyer and the seller, with the accompaniment of Standout .
- Legal Process and Notary Public: We provide advice on the legal validation of documents and support in notarial procedures.
Note:
- Standout is NOT responsible for non-compliance with the delivery of properties by third parties.
- Standout does NOT act as a financial institution, so it does not offer direct financing.
5.2. Property Rentals: Short and Long Stays
Standout manages property rentals in two ways:
- Short-term rentals: Stays for days or weeks in fully furnished and equipped accommodations.
- Long-Term Rentals: Rental contracts for three months or more, exclusively for furnished properties.
Steps to Rent a Property:
- Property Selection: The tenant reviews the options available on the platform and requests information.
- Availability Check: Standout validates dates and confirms availability.
- Reservation Process:
- Short-Term Rentals: Reservations are managed through the external Hostify platform, which allows for efficient management of the rental process.
- Long-Term Rental: A tenant document validation process is carried out on the Standout website.
- Contract Signing: Standout manages the signing of the lease contract.
- Property Handover: The tenant receives the keys along with a detailed inventory of the property's condition.
Important Considerations:
- All rentals are managed and administered directly by Standout .
- Subletting or commercial use of leased properties is not permitted.
- For long-term stays, utility usage limits are set; any excess will be borne by the tenant.
5.3. Reservation and Refund Policy
Rental property reservations are subject to a strict cancellation and refund policy.
Short-term Rental Reservations:
- If the guest cancels more than 30 days in advance , 50% of the reservation will be refunded.
- If you cancel less than 30 days in advance, there is no refund .
Long-Term Rental Reservations:
- The reservation fee is non-refundable in the event of withdrawal by the tenant.
- If the property is unavailable for reasons attributable to Standout , an equivalent alternative or full refund will be offered.
5.4. Property Registration on the Website
Owners interested in listing their properties on Standout must meet specific criteria for location, design, and commercial suitability.
Requirements to Publish a Property:
- Strategic Location: Properties located in prime areas of Medellín with proven demand.
- Design and Quality: Standout only accepts properties that meet high standards in architecture and design.
- Commercial Potential: The projected profitability of the property is evaluated before its publication.
- Owner Authorization: Standout must have a real estate representation agreement signed by the owner.
Important:
- Only Standout can upload properties to the platform.
- Self-management of listings by owners is not permitted.
5.5. Deleting Property Listings
Standout reserves the right to remove a property from the website under the following circumstances:
- If the property has been sold or leased and the owner has not reported it.
- If the property no longer meets Standout standards.
- If the owner breaches the terms of the representation agreement.
- By legal order or request of a competent authority.
Elimination Time:
- Immediate removal for legal reasons.
- Up to 15 business days for deletions requested by owners.
6. Data Protection and Privacy Policies
Standout SAS recognizes the importance of privacy and the protection of its Users' personal data. The collection, storage, processing, and use of personal information is governed by current Colombian legislation, particularly Law 1581 of 2012 and Decree 1377 of 2013 , which regulate the handling of personal data in the country.
By accessing and using the Standout website, Users expressly authorize the processing of their personal data under the terms described in this policy.

Standout collects information from its Users in order to provide a better experience and ensure the quality of its real estate services.
Data we collect:

- Facilitate real estate intermediation between buyers, sellers, landlords, and investors.
- Process reservations and payments for rentals or purchase and sale transactions.

- Conduct market and real estate trend analysis.
- Comply with legal and regulatory obligations in Colombia.
Note: Under no circumstances will Standout use personal data for purposes other than those mentioned here without the User's prior authorization.

8.1 Scope of Standout's Responsibility
Standout SAS (“Standout”) operates solely as a technology intermediary in real estate transactions, facilitating the initial contact and exchange of information between offerors (owners or real estate agents) and applicants (buyers or tenants) of real estate. By virtue of its role as an intermediary, Standout acts as a contractual party in the purchase, sale, or lease agreements, or other real estate agreements that may arise from the use of the website. Standout's responsibility is limited to providing the virtual platform, commercial support, and associated services for the publication and dissemination of real estate listings, ensuring their proper functioning and availability to the extent possible. As an intermediary, Standout assumes no liability for incorrect, incomplete, or outdated information provided by third parties (for example, owners, developers, or real estate brokers providing property information), nor for errors or omissions beyond the reasonable diligence the company applies in reviewing the content. Likewise, Standout will not be liable for disputes or claims arising between users (whether buyers, sellers, tenants, or landlords), as any conflict arising from a real estate transaction must be resolved directly between the parties involved. In short, Standout is responsible for the provision of its service as a contact platform to the extent of its intermediary functions, but not beyond that: it does not guarantee specific results in negotiations nor assume any obligations of the contracting parties in a real estate transaction.
8.2 Guarantees on Published Information
Standout strives to verify and moderate the information published in real estate listings to the extent possible, ensuring that listings are accurate and up-to-date at the time of publication. This includes performing a basic review of the property information provided by the advertiser and even requesting documentation or confirmation of certain details when deemed necessary. However, Standout does not guarantee the accuracy or continued validity of the published information, as the characteristics of the properties, their conditions, or availability may change without prior notice due to decisions or circumstances beyond Standout's control (for example, modifications made by the owner, changes in the sale or rental price, improvements or deterioration of the property, among others). Consequently, Standout is not responsible for changes in the conditions of the listed properties (such as changes in price, physical characteristics, legal status, or any other relevant condition) that occur after the information has been published on the platform. Likewise, Standout assumes no responsibility if a listed property becomes unavailable (whether because it has been sold, leased, or withdrawn from the market by its owner) at the time the user decides to express interest in it. Decisions made by owners or advertisers—for example, adjusting the property's value, modifying the conditions of the offer, or unilaterally canceling the property's availability—are beyond Standout's control and remain the sole responsibility of those third parties. Standout publishes listings for informational purposes, relying on the veracity of the information provided by the advertiser; therefore, it is the advertiser's responsibility to guarantee the authenticity and accuracy of such information, and the interested user is responsible for verifying any relevant information with the owner or corresponding agent before making any commercial decisions. Under no circumstances does the publication of a property on the website constitute a guarantee by Standout regarding the condition, quality, status, legal title, or actual availability of the property.
8.3 Disclaimer of Liability in Disputes between Parties
Standout does not act as a professional legal advisor, nor does it act as a party to negotiations or conclude contractual agreements between buyers and sellers of real estate. It merely facilitates business development between the parties through the website. Therefore, any dispute, difference, claim, or conflict arising in the course of a real estate transaction (for example, disagreements regarding price, the condition of the property, compliance with agreed-upon conditions, refunds, contract clauses, etc.) must be resolved exclusively between the parties involved, in accordance with the terms of the contract they have entered into and applicable laws. Standout is not responsible for mediating such disputes or imposing resolutions, and is exempt from any obligation to compensate for any damages that either party may claim as a result of the conflict between them. In the event of a legal dispute or disagreement between a buyer and a seller (or between a landlord and tenant), Standout assumes no liability for the actions or omissions of either party during the transaction. Any claim for breach of contract, hidden defects, damages, refunds, or other claims must be addressed and resolved directly between the seller and the buyer, or between the landlord and the tenant, as appropriate, using the legal mechanisms available for this purpose (direct negotiation, mediation, arbitration, or judicial proceedings). Standout may, at its sole discretion, cooperate by providing information in its possession to help clarify any incident (for example, contact information or communication records, provided that it is authorized by law or by the parties to do so), but in no event will it be obligated to participate in the resolution of the dispute nor will it be responsible for its outcome. The parties understand and agree that Standout is not an arbiter or guarantor of private agreements they enter into, and therefore shall not be liable for any non-performance, delays, damages, or any other dispute arising from such contractual relationships between users.
8.4 Limitations on Use of the Website
The user agrees to use the Standout website lawfully and in accordance with these Terms and Conditions, refraining from any activity that may compromise the security, stability, or proper functioning of the platform. It is strictly prohibited to use the site for illegal purposes, distribute malicious content (such as computer viruses), attempt to access other users' accounts or Standout systems without authorization, reverse engineer the platform, overload the infrastructure with automated programs (bots, scripts), or carry out any other action that may harm the functionality of the service or the experience of other users. Standout reserves the right to restrict, suspend, or terminate access to the website (including deactivating user accounts) if it detects improper use, suspicious activity, or violations of these Terms and Conditions. 8.5 Cases of Force Majeure and Exemption from Liability

A force majeure event or force majeure is defined as any unforeseeable event, or one that, although foreseeable, is unavoidable, is beyond Standout's reasonable control, and which prevents or hinders the normal performance of its obligations. In the event of a force majeure event or unforeseeable event, Standout's obligations will be suspended for the duration of the extraordinary situation, with normal activities resuming as soon as the event has ceased and conditions permit. During this exceptional period, Standout will be exempt from any liability for the failure to provide its services or the delayed performance thereof, to the extent that this is a direct consequence of the force majeure event in question. The user acknowledges that these extraordinary events may impact the operation of the platform and agrees that, under such circumstances, they will not pursue claims or legal action against Standout for any damages or losses that may arise. Standout, for its part, undertakes to inform users as soon as reasonably possible about the occurrence of events of this nature that materially affect the provision of the service, as well as to make commercially reasonable efforts to mitigate the adverse effects and restore the service as soon as possible, once the force majeure conditions have passed.
8.6 Jurisdiction and Applicable Law
Access to and use of the Standout website, as well as all legal relationships arising therefrom, shall be governed by the laws in force in the Republic of Colombia. In the event of any legal disputes or claims arising between users and Standout (for example, disputes related to compliance with these Terms and Conditions, use of the platform, or the services provided), the parties agree to submit to the exclusive jurisdiction of the competent courts of Colombia. Unless otherwise provided by a public policy regulation, any judicial proceeding shall be brought before the courts of the Republic of Colombia, in accordance with the rules of jurisdiction established by law. Additionally, given that Standout SAS is a company domiciled in the city of Medellín, any legal action requiring a specific territorial determination may be brought, at Standout's discretion, before the courts of the city of Medellín, Colombia, without prejudice to the applicable general jurisdiction. Use of the platform from locations outside of Colombia will be under the user's sole responsibility, and they must ensure compliance with any applicable local laws. However, the user understands that any legal relationship or dispute they may enter into with Standout will be governed in all cases by Colombian law, and by accepting these Terms and Conditions, they expressly waive any other jurisdiction or law that may apply to them based on their domicile or location from which they use the service. Finally, if any provision of these Terms and Conditions is declared invalid, illegal, or unenforceable by a competent judicial or administrative authority, such declaration will not affect the validity or enforceability of the remaining provisions, which will remain in full force and effect. The parties agree to replace the affected provision with another that most closely matches the economic and legal intent of the original provision, maintaining the legal protection of Standout and the rights of users to the fullest extent permitted by law.
9. Modifications to the Terms and Conditions
Standout SAS reserves the right to modify, update, or delete any provision contained in these Terms and Conditions at any time and without prior notice to Users.

10.1. Interpretation of the Terms and Conditions
Independent Clauses
- If any provision is declared illegal, invalid or unenforceable by a judicial or administrative authority, this will not affect the validity of the remaining provisions.
- The affected provision will be replaced by another that reflects, as closely as possible, the original intention.
Language and Definitions
- Terms in singular or plural, as well as in masculine or feminine gender, should be interpreted according to the context in which they are applied.
- The headings and subheadings used in this document are for reference only and do not affect the interpretation of the clauses.
Assignment of Rights and Obligations
- The User may not assign his rights or obligations without express authorization from Standout .

11. Payment Gateway Usage Policy
11.1. Use of MercadoPago as a Payment Provider
Standout SAS uses MercadoPago as its official payment gateway to process transactions on its website. By making a payment, the User automatically accepts MercadoPago's Terms and Conditions .
MercadoPago is a third-party service managed by an independent company. Therefore, Standout is not responsible for:
- Payment gateway failures.
- Transaction rejections.
- Processing times.
- Payment reversals.

11.4. Refund and Reversal Policy

Refunds only apply in the following cases:

Standout SAS implements security measures to prevent fraud in payments made within its platform. However, Standout is not responsible for external fraud or the misuse of the User's financial information.

- 🚫 Express request from the User to close their account.
- 🚫 Business decision to modify, limit, or discontinue the operation of the website.

13.2. Applicable Law and Dispute Resolution
These Terms and Conditions are governed by the legislation in force in the Republic of Colombia .
